1. Scope
These guidelines explain how TurboDuck LLC responds to requests from law enforcement and government agencies for information about AFF Dating accounts. They are not legal advice and don't create any obligation or right for any person or agency.
2. Information we may have
Depending on the account and how long ago the activity occurred, we may hold basic account information (the Apple user identifier, email address if shared, account creation date and registration IP address), profile information and media, greetings and messages, purchase records, and limited logs. Our retention periods are described in our Privacy Policy; information that has been deleted may no longer be available. Please identify the account by the account ID shown in the app, the member's nickname and city, and the approximate dates of the activity.
3. Legal process required
- A valid subpoena or equivalent legal process for basic subscriber information.
- A court order under 18 U.S.C. § 2703(d) for other non-content records.
- A search warrant, issued under the procedures of the Federal Rules of Criminal Procedure or equivalent state warrant procedures, for the contents of communications.
- Requests from outside the United States should be made through a Mutual Legal Assistance Treaty (MLAT) or letters rogatory.
4. Emergency requests
If you believe there is an emergency involving the danger of death or serious physical injury to any person, we may disclose information without legal process under 18 U.S.C. § 2702(b)(8) and (c)(4). Email turboduck@foxmail.com from an official government email address, with a description of the emergency, why it requires disclosure without delay, and the account identifiers.
5. Preservation requests
We will preserve available records for 90 days after receiving a valid preservation request under 18 U.S.C. § 2703(f), and for one additional 90-day period if we receive an extension request.
6. Notice to members
Our policy is to notify members of requests for their information before disclosure, unless the law prohibits notice, or notice would be futile or create a risk of harm, such as in emergencies or cases involving child safety.
7. How to submit a request
Send requests by email to turboduck@foxmail.com or by mail to TurboDuck LLC, 2461 Charmaine Lane, Monticello, FL 32344, United States. Please include the requesting agency, the officer's name, badge or ID number, official email address and phone number, the legal basis for the request, the account identifiers, and a response deadline. Requests that are incomplete or not legally valid may be declined.
