The short version
- Only share photos and videos that you own or have permission to use.
- Rights holders can send a DMCA notice to our designated agent.
- We remove infringing content and terminate repeat infringers.
1. Respecting intellectual property
TurboDuck respects the intellectual property rights of others and expects members to do the same. Only upload photos, videos and text that you created or have the right to use. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (“DMCA”).
2. Sending a copyright notice
To report content on AFF that you believe infringes your copyright, send our designated agent a written notice that includes:
- your physical or electronic signature;
- a description of the copyrighted work you believe has been infringed;
- a description of the material you believe is infringing and enough information for us to find it, such as the member's nickname, city and a screenshot;
- your name, mailing address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Counter-notices
If your content was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to our designated agent that includes:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which TurboDuck may be found), and that you will accept service of process from the person who provided the original notice or their agent.
We may restore the material 10 to 14 business days after we receive a valid counter-notice, unless the original complainant tells us that they have filed a court action.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of members who repeatedly infringe the rights of others.
6. Trademarks and other rights
To report a trademark issue or other intellectual property concern, email turboduck@foxmail.com with your contact details, the right you believe is affected, and the content involved.
7. Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
